Backlash from Seal of Biliteracy

I am in the beginning stages of convincing state leadership that we need to consider a seal of biliteracy. My supervisor asked me to ask leaders from other states if they have ever had an issue with students demonstrating proficiency in a second language but unable to demonstrate proficiency (via state testing) in their native English language. If this has occurred was there any backlash or negativity towards the Seal of Biliteracy? Thanks to anyone who can provide me with feedback on this.
